After a Babson College freshman decided to not return to the United States, a federal judge dismissed her lawsuit challenging her initial deportation, which the government has admitted was a mistake, The Boston Globe reported.

A federal judge said it was a “sad truth” that he lost jurisdiction over the case when Any Lucia López Belloza decided to not board a government-offered flight back from Honduras. Belloza previously said she didn’t want to return out of fear that she would be deported again. She was detained in November while traveling home for the holidays.

Her lawyers have appealed the dismissal. The judge found that the government complied with his order to bring Belloza back by offering the flight, according to the Globe.
